The Chesapeake Public Schools purchasing staff subscribes to the following state statutes as they relate to ethics in public contracting.

Article 6 of the Virginia Public Procurement Act
State and Local Government Conflict of Interest Act (for example: Sections 2.2-3106-3109)
Virginia Governmental Frauds Act (18.2-498.1 
et seq.)
Chapter 10 of Title 18.2

Further, no staff member responsible for the procurement transaction may participate in that transaction if that staff member:

  • is employed by a bidder participating in the transaction

  • has immediate family or a partner employed by the bidder participating in the transaction

  • has immediate family or partner which is seeking employment by a bidder participating in the transaction

  • has a personal interest in the procurement transaction as defined by the State and Local Government Conflict of Interest Act

No staff member responsible for a purchasing transaction will:

  • demand any gifts, money, loans from a bidder as a condition for doing business with the school system

  • accept any gifts, money, loans, refreshment and/or entertainment from a bidder unless such refreshment and/or entertainment is conducted at an officially sanctioned conference/seminar and is not for the sole use of the school employee

  • participate in any kickback schemes with any bidder, subcontractor, or supplier.  No kickback may be demanded or received by any party involved with the public procurement of goods and services

Any staff member willfully violating the provisions set forth here and contained in the heretofore mentioned statues is subject to a fine and/or penalty as provided by law and shall forfeit his/her employment if found guilty.  Any bidder found in violation of those provisions will be prosecuted to the full extent of the law.
